Cain Velasquez's Sentencing in Alleged Attempted Murder Case Pushed Back to March 2025

Former UFC heavyweight champion Cain Velasquez won’t know his fate until March.

In August, Velasquez pleaded no-contest to a series of charges including premeditated attempted murder, felony assault charges, and other related gun charges after he was arrested back in 2022 following a high-speed chase where he allegedly fired several rounds from a handgun at a car containing Harry Goularte, a man accused of molesting Velasquez’s son at a daycare owned by his mother.

Velasquez faces a potential penalty anywhere from probation to life in prison.

A motions hearing for Velasquez is still on the docket for Friday, January 24 but his sentencing and probation hearing is now scheduled for March 24.

Velasquez was arrested on February 28, 2022, after he allegedly fired several rounds from a .40-caliber handgun at a vehicle containing Goularte. Instead, a bullet struck Goularte’s stepfather Paul Bender who was operating the vehicle at the time of the incident. Following the chase, Velasquez was arrested by the Morgan Hill Police Department without incident.

He remained behind bars for eight months after being denied bail multiple times.

Finally, in November 2022, Velasquez was released on a $1 million bond. He promptly returned to coaching at American Kickboxing Academy and has also made multiple appearances at professional wrestling events.

Recently Velasquez signed a deal with the Global Fight League to coach the Dubai team alongside his longtime head coach and AKA founder Javier Mendes.

Harry Goularte scheduled for June trial date after allegedly molesting Cain Velasquez’s son

On January 8, Harry Goularte was given a June 2 jury trial date by Judge Benjamin Williams of Santa Clara County in California. He’s facing one felony count of lewd acts with a minor after he was accused of molesting Velasquez’s then-four-year-old son.

Williams also ordered that Goularte must appear in person for his jury trial. He has been out on bail with GPS monitoring since his initial arrest nearly three years ago.

Cain Velasquez has been granted another requested delay for his attempted murder trial.

Judge Panteha Saban granted the request made by Velasquez’s attorney Renee Hessling on Wednesday, pushing the anticipated trial date out to August 2. This is the third time the trial has been pushed back thus far.

Cain Velasquez, 40, is facing multiple charges after allegedly engaging another vehicle in an 11-mile-long high-speed chase in February 2022. The former UFC heavyweight champion allegedly fired multiple rounds from a .40 caliber handgun at the other vehicle carrying Harry Goularte, the man accused of molesting Velasquez’s son at a daycare facility operated by his mother, Patty Goularte.

During the incident, Goularte’s stepfather Paul Bender was reportedly struck in the arm by a bullet. His injuries were non-life threatening.

Cain Velasquez was arrested shortly after and remained in jail for eight months after multiple requests for release on the condition of house arrest were denied. Finally, Judge Arthur Bocanegra granted Velasquez’s release in November on a $1 million bond. Since then, Velasquez has been permitted to appear at professional wrestling events while he awaits trial.

Harry Goularte and Family Face a Civil Suit For the Alleged Sexual Assault of Cain Velasquez’s Son

In June, a civil suit was filed against alleged child molester Harry Goularte as well as his business, Certified Custom Concrete, his mother Patricia Goularte, and her business, Patty’s Childcare, and his stepfather Paul Bender. All parties reportedly face a series of allegations as it pertains to the sexual assault of a minor. A 13-page document filed in a Santa Clarita County court claims that Goularte had inappropriate contact with the child, including exposing himself “numerous times” from 2021-2022.

Goularte’s mother and stepfather are listed in the court documents as they allegedly “allowed this behavior and conduct to occur and continue to occur and failed to adequately monitor and supervise [the victim] and Harry.”

“Despite the warnings, observations, and signs of inappropriate behavior and conduct, Harry, at all times, remained permitted to reside on the property of Patty’s Childcare,” the document states.

MMA fans rejoiced as former UFC heavyweight champion Cain Velasquez is finally going home to his family.

The UFC icon has been behind bars since February after allegedly engaging in an 11-mile high-speed chase. Velasquez was reportedly pursuing a vehicle carrying Harry Goularte, the man he has accused of molesting his 4-year-old son and other children at a daycare run by Goularte’s mother. Velasquez is said to have fired multiple shots at the vehicle using a .40 caliber handgun and striking the driver, Goularte’s stepfather Paul Bender.

Due to the premeditated nature of the incident, Cain Velasquez was charged with 10 offenses, the most serious being attempted murder which carries a sentence of 20 years to life in prison. The nature of the incident also found Velasquez and his attorney Mark Geragos repeatedly denied bail. That changed this week when Judge Arthur Bocanegra agreed to release Velasquez on $1 million bail which Velasquez posted. He was released early Wednesday morning.

“Mr. Velasquez, I would not release you if I was not convinced that upon a release at this time, eight months later, that you would be a danger to Harry Goularte primarily, Patricia Goularte, or Paul Bender,” Bocanegra said. “If you are as devoted a husband and father, I’m confident and have to believe you will not jeopardize anything that would take you away from your son, your daughter, your family. I hope you don’t prove me wrong.”

Cain Velasquez is Thankful for the Support of Fans and Colleagues

Following his release, Cain Velasquez made a statement to local news station KRON-4.

“Just feel blessed,” Velasquez said. “Ready to go home, be with the loved ones, family, and friends, and make something positive of this whole situation. Just thank you to everybody who had my support. I love all of you. Just always continue to be better as a person, always do good things and just make something positive of this terrible situation. My family and I, we’re going to do that.”

The conditions of his parole require him to remain under house arrest with GPS monitoring. He is not allowed to have any firearms in his home and was ordered to undergo outpatient treatment for traumatic brain injury and CTE (chronic traumatic encephalopathy). Velasquez will also be required to attend counseling for parents of children who have been victimized by sexual abuse.

Cain Velasquez will be back in court on November 21st for the next hearing in his case.
