Cain Velasquez has received a new date for his plea hearing while Harry Goularte, the man accused of sexually molesting Velasquez’s son, was charged with a civil lawsuit.

The former UFC Heavyweight champion, Cain Velasquez, has been given the new date of Aug. 19 for the plea hearing in his attempted murder case in California. Another court date of Aug. 5 was scheduled for motion hearings in the criminal case before the official plea hearings two weeks after.

Velasquez is currently being held without bail. He was arrested after an alleged high-speed chase where he fired multiple shots in the direction of a car carrying Goularte, who had been arrested and released from custody based on charges of lewd acts with a minor child. Goularte’s stepfather, Paul Bender, was allegedly shot in the arm instead.

Cain Velasquez was denied bail on two occasions by Judge Shelyna Brown prior to having his plea hearing pushed back again. Judge Brown deemed him to be a danger to society and chose to keep him in custody while Goularte was allowed to walk out.

Harry Goularte gets charged with sexual battery on a minor

A comprehensive lawsuit has been filed against Goularte, his business Certified Custom Concrete, his mother Patricia Goularte, her business Patty’s Childcare, and his stepfather, Bender, first reported by MMA Junkie.

A four-year-old victim with the initials “C.V.” who was previously revealed to be Velasquez’s son by attorney Mark Geragos is identified. The lawsuit alleges general negligence, negligent hiring, supervision, retention, training and investigation, sexual battery, and sexual misconduct/sexual harassment.

Per reports based on MMA Fighting obtaining lawsuit documents, Goularte had “daily access” to the children being cared for at his mother’s business and was alone with the victim in the bathroom and the outside playhouse on a number of occasions.

Goularte is accused of removing the victim’s clothing, touching the victim’s scrotum and penis, and exposing himself to the child. Goularte is accused of doing so “numerous times during 2021 and 2022.” The lawsuit also notes that the minor child “suffered extensive personal injury including, but not limited to, severe emotional distress, humiliation, and embarrassment as a result of the actions and conduct” of Goularte.

The first hearing is set for Sept. 6 for a conference on case management. Goularte is scheduled to be back in court for his criminal case on Sept. 20 for a preliminary hearing.

If convicted of all charges, Goularte faces up to eight years in prison and/or a $10,000 fine.

Cain Velasquez faces attempted premeditated murder charges that carry a sentence of 20 years to life in prison if convicted.

Harry Goularte, the alleged child molester of one of former UFC champion Cain Velasquez’s children, plead not guilty in court on Monday.

As reported by MMA Junkie and other outlets, Goularte’s attorney Stephen DeFilippis announced the not-guilty plea.

Goularte’s next court date will take place at a preliminary trial hearing on Sept. 20 in San Jose, CA. He faces a felony of lewd acts with a minor which includes a sentence of up to eight years in prison and/or a $10,000 fine if convicted.

Velasquez faces an attempted murder charge, among other charges, after a high-speed chase between Velasquez, Goularte, and Goularte’s stepfather ended in a shooting. According to investigators, Goularte’s stepfather suffered a gunshot wound as a result of the incident.

Goularte is under investigation for allegedly sexually assaulting Velasquez’s four-year-old son at a daycare run by his mother. He took Velasquez’s son to a bathroom, and touched his genitals around 100 times, as claimed by Velasquez’s family.

Shortly after Goularte’s arrest, he was granted $50,000 bail and was allowed to attend the pre-trial hearings virtually. Meanwhile, Velasquez was denied bail multiple times and faces up to 20 years in prison if found guilty of attempted murder.

Goularte won’t be allowed to attend virtually for the upcoming trial proceedings and will be required to attend in person.

Goularte has opted not to appear in person for as long as the judge allows due to fear of his own safety, as his legal team told various media. He faces a felony charge of lewd acts with a minor if convicted.

Goularte was recently involved in an incident with Velasquez earlier this year, resulting in Velasquez facing an attempted murder charge. As Velasquez confronted him, Goularte and his stepfather escaped in their vehicle before a high-speed chase ensued.

Goularte’s stepfather was allegedly shot by Velasquez during the incident and faced a non-life-threatening injury. Velasquez faces a minimum of 20 years in prison if found guilty of attempted murder.

Goularte appeared in South County Morgan Hill Courthouse virtually for his plea hearing, which lasted only two minutes and was delayed until June 6. Judge Le Jacqueline Duong approved a continuance for Goularte to attend proceedings virtually until further notice.

Goularte has been out on bail since February on the condition that he remains home with a monitoring device and isn’t within 100 yards of a child under the age of 14.

Protestors were rampant outside of the courthouse during the hearing, with many holding signs alluding to their stances that Goularte should be in jail as the trial moves forward.

“That’s what sexual predators do. They deny everything. And because the law doesn’t do anything to protect the children or even women who are sexually harassed, everything’s still the same. So I think that’s where we need to change the law,” said protestor Lily Robinson.

“It wasn’t justice. Somebody’s able to commit a crime like that against a child, somebody that believes in the justice system and it fails, and they have to take justice in their own hands. That’s the way the world is right now,” said another protestor, Jason Goelz.

Emotions have run high over the past few months since the investigation into both Goularte and Velasquez. The judge presiding over the Velasquez case requested extra security in light of alleged threats.

Goularte and his legal team have continued to deny all accusations.
