Nick Diaz’s recent DUI-related arrest is his second in 10 months

Nick Diaz’s recent arrest for suspicion of driving under the influence, along with a trio of other charges, was actually the second such incident over the past ten months for the popular UFC welterweight, MMAFighting.com confirmed on Friday following an initial report from FOXSports.com.

In addition to his September 6 arrest, Diaz was also arrested on November 20, 2013 for driving under the influence, according to Detective Hettie Schaffer of the Lodi Police Department. FOXSports.com listed Diaz’s charges as: driving under the influence, driving under the influence with an alcohol or drug level above .08, and unsafe speed for prevailing conditions.

Diaz missed several court dates following the initial arrest, until ultimately surrendering in court on August 21, 2014 after a bench warrant was issued for his arrest.

Diaz was subsequently released on $25,000 bail, and a date for his arraignment was then scheduled for September 25.

Coincidentally, that date coincides with the approximate date Diaz is now expected to appear in court as a result of his latest arrest. Diaz was arrested by members of the Lodi Police Department in the early morning hours on September 6 on charges of suspicion of DUI, obstructing a police officer, destruction of evidence and driving with a suspended license, MMAFighting.com confirmed on Friday.

Diaz was arrested without incident, however according to Sergeant Steve Maynard, he attempted to induce himself to vomit several times against the commands of officers as a means to circumvent a breath sobriety test, thus landing him charges of obstructing a police officer and destruction of evidence.

Diaz was released from Lodi City Jail the same morning of his September 6 arrest, and is expected to appear in court approximately 21 days from the date.

Diaz is currently scheduled to headline UFC 183 opposite Anderson Silva on January 31, 2015. The event is already one of the most anticipated UFC pay-per-views on the promotion’s present scheduled, and on Friday UFC officials released the following statement.

“We are aware of the situation and are in the process of gathering the facts. We understand that there is a legal process that will now take place and that Nick Diaz will have the opportunity to address the situation in the near future.”
