Former MMA fighter Scott Fairlamb has filed an appeal following his conviction of assaulting a police officer during the capitol siege in Washington D.C. on Jan. 6.

Scott Fairlamb, a New Jersey gym owner and former MMA fighter, accepted a plea deal and avoided trial. In August, Honorary Judge Lamberth implied that if Scott Fairlamb would have gone to trial, his sentence would have been far lengthier than the 41-months he received as part of his plea deal. Fairlamb was involved in the capitol riot on Jan. 6 and was the first violent rioter charged with crimes.

Prosecutors allege that Scott Fairlamb was one of the first rioters to enter the Senate side of the building during the attack in Washington D.C. During his court appearance in Aug., Fairlamb waived most of his appeal rights.

U.S. District Judge Royce Lamberth condemned his involvement during the initial court preceding in Aug.

“You were part of the overall circumstances that led to the obstruct [and the] inability of congress to function, the inability of the electoral college to go forward that day,” said Lamberth, a Ronald Reagan appointee, at the hearing. “The offense itself that you committed is so at the heart of our democracy that I cannot in good conscience go below the [sentencing] guidelines.” Judge Lamberth says to Fairlamb on Nov. 10.

Criminal defense attorneys Dennis Boyle and Blerina Jasari orchestrated the Wednesday post-conviction appeal filing for Fairlamb’s case. Scott Fairlamb is now the second defendant to appeal his conviction during the Capitol insurrection. Paul Hodgkins, a fellow perpetrator during the attack on the congressional building, was recently sentenced to eight months in prison following his involvement.

While Fairlamb’s attorneys dispute the conviction, as it stands, Scott Fairlamb has been met with a heavy gavel and is still looking at 41-months behind bars.

Former MMA fighter and gym owner Scott Fairlamb has been sentenced for 41 months in prison for assaulting an officer during the Capitol Riots in Washington, D.C on Jan. 6th of this year.

Fairlamb is the first rioter to be imprisoned for his violent actions during the riots. He had originally pleaded guilty back in August. Fairlamb owned an MMA gym in New Jersey and also had one professional fight under his belt in the New Jersey area.

Fairlamb stormed the building as well and documented everything he did with pictures and videos. There were also messages that he sent to some of his friends where he said he would do it again. According to CNN, Fairlamb said “I truly regret my actions that day. I have nothing but remorse,” while teary eyed addressing the court.

Fairlamb will also serve 36 months of supervised release after he serves his 41 months sentence in prison. The judge in the hearing told him that he was doing the right thing by not taking this to court to be acquitted. He didn’t believe a single jury would find him not-guilty and also claimed the other’ like Fairlamb should follow in his footsteps.

There was police body camera video of Scott Fairlamb yelling and taking a swing at the officer after pushing him over.

Fairlamb told the officer, “You have no idea what the f**k you’re doing.” before hitting the officer. The prosecutors alluded that Fairlamb was one of the first people to storm inside the senate side of the building during the riots. Fairlamb claims to have upset most of his family and his father who was a veteran. He has also apparently cut ties with his brother, who is in the secret service.

Former MMA fighter Scott Fairlamb took part in the infamous January 6 Capitol Riot and is now facing a sentence of 41-months in prison.

News of the sentencing came down on Wednesday. This marks the first violent rioter sentenced for their involvement in the Jan. 6 attack on police in the nation’s capital. Scott Fairlamb pleaded guilty to assaulting a police officer and obstructing an official court proceeding in August.

According to the honorary judge, the crime was much more serious than what appeared at face value, like property damage.

“It’s such a serious offense… an affront to society and to the law to have the Capitol overrun and the function of government stopped” said Judge Royce Lamberth, noting that the assault struck “in the heart of our democracy.” h/t CNN.

Fairlamb’s sentence will likely set a precedent for any other rioters who will be met with charges for their participation in the Jan. 6 Capitol Riot. During the court proceedings, Scott Fairlamb was apologetic for his actions and hopes the honorable judge will find mercy when rendering a verdict.

“I truly regret my actions that day. I have nothing but remorse,” Fairlamb said, visibly crying in court Wednesday as he asked the judge for “mercy.”

According to the judge, Fairlamb made the right decision by accepting the plea agreement for 41-months. Apparently, Fairlamb would have faced far harsher punishments by gambling with a jury.

Before the sentence was read out loud, Judge Lamberth told Fairlamb, “Had you gone to trial, I don’t think there’s any jury that could have acquitted you…you couldn’t have beat this.”

Prosecutors have alleged that Scott Fairlamb was one of the first rioters to enter the Senate side of the building during the attack in Washington D.C. Four days after the insurrection on Capitol Hill, Fairlamb is alleged to have tagged Missouri Democrat Rep. Cori Bush on Instagram, and stated, “shoulda lit your ass up”.
