Conor McGregor’s legal team is attempting to get rid of the lawsuit that is being brought forward by fellow UFC star Michael Chiesa. He filed a civil lawsuit against Conor after the Irish superstar started a melee in Brooklyn, New York, earlier this year.
The UFC lightweight star has filed a civil lawsuit against McGregor as he allegedly suffered damages due to McGregor’s infamous bus attack. The lawsuit states that Chiesa suffered “serious personal, economic, and other injury,” as well as “severe emotional distress, mental trauma, and/or bodily harm.” It also accuses McGregor of negligence, assault, battery and infliction of emotional distress.
Conor McGregor’s Legal Team Fires Back
McGregor’s attorney James M. Catterson filed a motion to dismiss the suit in New York State Supreme Court on November 30th. The motion noted that the injuries Chiesa sustained weren’t a result of the attack. Thus, they believe that Chiesa cannot claim negligence or infliction of emotional distress, only battery, and assault.
“While the conduct alleged in the complaint is unquestionably inappropriate. It does not approach the rigorous standard of outrageousness as defined by New York courts. Therefore further supporting the dismissal of the intentional infliction of emotional distress claim,” said the attorney (H/T to MMAFighting).”
“Chiesa, a seasoned combat sports fighter, fails to plead any allegations containing even a scintilla of factual specificity regarding the alleged emotional distress. The two emotional distress causes of action allege only that Defendants ‘caused severe emotional distress, mental trauma, and/or bodily harm to the plaintiff.’”
Attempt To Dismiss
Chiesa and Anthony Pettis were slated to fight each other at the UFC 223. However, the bout got scrapped once Chiesa suffered facial lacerations due to this bus attack. Catterson continued by stating that they believe these claims should be dismissed.
“The complaint contains no other information supporting these alleged emotional injuries. These boilerplate, unsubstantiated allegations do not adequately plead a claim for emotional distress, and therefore Chiesa’s intentional and negligent infliction of emotional distress claims must be dismissed.”

The fiasco that was Conor McGregor and Khabib Nurmagomedov is done – for now. However, the aftermath of McGregor’s UFC 223 media day bus attack lives on.
One of the fighters injured during the ordeal was UFC welterweight Michael Chiesa. Chiesa was cut by shards of glass from McGregor tossing a dolly through a fighter bus window. He was removed from his scheduled fight with Anthony Pettis as a result.
Chiesa is now suing McGregor over the incident, much to the dislike of the Irishman’s fans. Speaking to “The MMA Hour” recently, “Maverick” revealed that some McGregor fans have actually been sending some hurtful messages to his mother and girlfriend (via MMA Fighting):
“I’m gonna tread lightly with this, obviously I can’t say a whole lot. But it just has not been good. Even my girlfriend and my mom get messages and comments. They’re not a part of this and it’s kind of a shame when — my mom’s a sensitive lady and I do my best to protect her and stuff.
“And when she tells me about some of the mean things that are getting sent her way it’s really, it’s a shame. Anybody can say whatever they want to me. This is about me, this isn’t about my family. And, you know, today hasn’t been great.”
Chiesa wasn’t the only fighter affected by the attack.
Flyweight Ray Borg had some glass residue enter his eyes, affecting his vision and canceling his fight as well. McGregor was targeting UFC lightweight champion Khabib Nurmagomedov.
Of course, McGregor and Khabib fought earlier this month (Sat. October 6, 2018) at UFC 229. “The Notorious” was defeated via fourth-round submission.
His lawsuit with Chiesa is ongoing. From the sound of how things are proceeding, ‘Maverick’ most likely wants it over sooner than later.

It used to be that fighters wanted to cut as much weight as possible in an attempt to compete at the lightest weight class possible. The thought was, having a substantial size advantage would translate into easier fights. Although many fighters have had success with this blueprint, in recent years the paradigm has shifted.
Fighters like Sam Alvey and Anthony Smith have recently decided to change things us. Both men were competing at middleweight, and having decent success, but since moving to light heavyweight both men have fast-tracked their fight careers. Smith is fighting Volkan Oezdimer in a potential 205-pound title eliminator bout, and Alvey has won two of three since changing classes.
That got us thinking here at LowkickMMA. Could other fighters benefit from switching things up? Here is our list of six fighters who could win gold at a different weight class:
Kelvin Gastelum – Welterweight
Fighters changing weight classes to better their performances is old hat. Take The Ultimate Fighter 17 winner Kelvin Gastelum.
After winning TUF 17, Gastelum announced he would be moving down to welterweight. The then 21-year-old Gastelum had success at 170 pounds despite battling with weight issues.
After repeated failed attempts to make the welterweight limit, UFC President Dana White strongly urged Gastelum to move back up to 185 pounds. Since moving back to middleweight Gastelum has gone 5-2, beating former middleweight champion Michael Bisping in the process.
He’ll now challenge Robert Whittaker for the middleweight title, but has often teased a return to welterweight to compete for that belt as well.
Gold could very well be in the future for Gastelum. Whether it’s at middleweight or welterweight remains to be seen.
